Article 3 – Applicability
These Terms and Conditions apply to every offer made by the entrepreneur, every distance contract concluded, and all orders between entrepreneur and consumer. Prior to concluding the contract, the text of the Terms and Conditions is made available to the consumer, including electronically where applicable. In case of conflict with other specific product or service conditions, the consumer may refer to the most favorable provision. If any provision is invalid or annulled, the remaining terms remain valid. Situations not covered must be interpreted in line with the spirit of these Terms.

Article 4 – Offer
Each offer clearly indicates any validity limits or conditions. The offer is binding until accepted by the consumer. Product descriptions and images are truthful, but colors and details may vary slightly. The offer specifies the price, any additional costs such as customs, VAT, and shipping, methods of acceptance, payment and delivery, withdrawal rights, contract storage, verification and correction of provided data, available languages, codes of conduct, and minimum duration of distance contracts.

Article 5 – Conclusion of the Contract
The contract is considered concluded once the offer is accepted by the consumer. In the case of electronic acceptance, the entrepreneur immediately confirms receipt. The entrepreneur adopts technical and organizational measures to ensure payment security and data protection.

Article 6 – Right of Withdrawal
The consumer may withdraw without reason within 30 days of receiving the product. During this period, the product must be treated with care. In case of withdrawal, the consumer must return the product with all accessories in the original packaging where possible, following the entrepreneur’s instructions. The withdrawal notice must be given within these 30 days, with return within the following 30 days.

Article 7 – Costs in Case of Withdrawal
Return shipping costs are borne by the consumer. The amount paid will be refunded within 30 days of withdrawal, provided the product has been returned or proof of shipment has been provided.

Article 8 – Exclusion of the Right of Withdrawal
The right of withdrawal may be excluded for customized products, clearly personal items, perishable goods, sealed goods for hygiene reasons, and software with a broken seal, as well as specific services such as accommodation, transport, catering, leisure, or betting. The exclusion must be clearly stated in the offer.

Article 9 – Price
Prices indicated are valid for the specified period and may change only due to VAT modifications or market fluctuations. Prices exclude any customs charges. Printing errors do not bind the entrepreneur.

Article 10 – Conformity and Warranty
Products supplied comply with the stated specifications and applicable laws. Any defects must be reported within 14 days of delivery. The warranty does not cover damage caused by improper use, unauthorized repairs, or abnormal conditions.

Article 11 – Delivery and Execution
Delivery is made to the address provided by the consumer. Orders will be executed within 30 days unless otherwise agreed. In case of delay or inability to deliver, the consumer may withdraw without costs. The entrepreneur assumes the risks until delivery.

Article 12 – Continuing Contracts: Duration, Withdrawal, and Renewal
The consumer may withdraw from fixed-term or indefinite contracts by observing a notice period of up to one month, unless specific provisions apply for periodic subscriptions such as newspapers or magazines. Contracts may not automatically renew beyond the specified limits.

Article 13 – Payment
Payment must be made within 7 days from the start of the withdrawal period. Any errors in payment details must be reported immediately. In case of non-payment, the entrepreneur may charge reasonable fees.

Article 14 – Complaints
Complaints must be submitted within 7 days of discovering the defect. The entrepreneur will respond within 30 days. If the complaint is justified, the entrepreneur will replace or repair the products free of charge.

Article 15 – Applicable Law
Contracts between the entrepreneur and the consumer are exclusively governed by Dutch law.

Article 16 – CESOP
From 2024, in implementation of the payment information regulations (CESOP), payment service providers may register data in the European Central Electronic System CESOP.
